Compliance

Compliance documented on every opportunity.

Buyers carry real risk when they contact consumers. Every opportunity arrives with documented consent, an independent certificate and a clean scrub, and you can verify each of them yourself.

Compliance standards

Five standards, applied without exception.

Buyers carry the risk when they make contact. Every opportunity arrives with the documentation you need to stand behind it.

  • TrustedForm documentation

An independent TrustedForm certificate is captured and delivered with every opportunity.

  • Litigator and DNC scrubbing

Every record is scrubbed through The Blacklist Alliance for known TCPA litigators and the federal DNC registry.

  • Express written consent capture

Clear consent language is presented and accepted before any submission is made.

  • No prerecorded or automated messaging

Contact is never made with prerecorded or artificial voice messages.

  • Dynamic caller ID management

Caller ID is managed dynamically and kept accurate on outbound contact.

Our approach

The Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule and a growing number of state telemarketing laws regulate how businesses contact consumers by phone and text. Penalties are assessed per call or message, so a single poorly documented batch can create real exposure for the buyer who makes contact.

Our approach is simple. Every opportunity is held to the same documentation standard, regardless of source, and the evidence travels with the record so you never have to take consent on faith.

This page describes our standards. It is not legal advice. Every buyer should review their own obligations with qualified counsel.

Express written consent is captured before any submission is made. The consent language is displayed clearly next to the submit button and, in plain terms, covers:

  • That the consumer is asking to be contacted about their motor vehicle accident claim
  • That contact may come from Case Growth Pro and from the law firm or legal service provider their information is shared with
  • That contact may be by phone call or text message, including to a mobile number
  • That consent is not a condition of any purchase or service
  • That message and data rates may apply, and how to opt out
  • Links to the privacy policy and terms

Consent language is versioned, and buyers can request the current version for their compliance team to review.

TrustedForm documentation

A TrustedForm certificate is captured for every opportunity. TrustedForm is an independent third party service that records the consumer's session on the form, including the page content, the consent language shown and the time of submission. The certificate URL is delivered with each opportunity so you can retain it in your own TrustedForm account.

Litigator and DNC scrubbing

Every record is scrubbed through The Blacklist Alliance before delivery, against known TCPA litigators and serial plaintiffs and against the federal Do Not Call registry. Records that fail the scrub are not delivered. Scrubbing supplements consent; it never replaces it.

Contact practices

  • No prerecorded or automated messaging. Prerecorded and artificial voice messages are not used.
  • Dynamic caller ID management. Caller ID is managed dynamically and kept accurate.
  • Expected contact. Consumers are told who they will hear from, so your contact is expected rather than a surprise.
  • Agreed hours. Live transfers only run in hours agreed with each buyer.

Traffic source standards

Opportunities come from O&O traffic acquisition channels and properties, supported by a vetted network of owned and partner traffic sources. Partner sources are reviewed before they are used and are held to the same consent, certificate and scrub requirements as our own properties.

Why exclusivity helps

Shared leads put one consumer in front of several buyers, which means calls from businesses the consumer may never have heard of. That pattern drives complaints and claims. Because every opportunity goes to one buyer, the consumer hears from the firm they were told to expect.

Opt outs and consumer rights

Consumers can revoke consent at any time by any reasonable means, including by telling us they no longer wish to be contacted, replying STOP to a text message, or submitting a request through our privacy request form. Opt outs are honored and recorded. More detail is in our TCPA and consent disclosure and privacy policy.

Buyer responsibilities

Compliance is shared. Buyers agree to:

  • Contact consumers only about the matter they asked about
  • Honor opt out requests promptly and maintain their own internal Do Not Call list
  • Follow applicable federal and state telemarketing and attorney advertising rules
  • Not resell or share opportunities outside the agreed terms
  • Retain TrustedForm certificates and records for their own compliance files

Records and audits

For every delivered opportunity, the submission data, consent details, TrustedForm certificate, scrub result and delivery record are retained. To review a specific opportunity, send the lead ID through the contact form.
